By accessing or using InkSpark ("the Service"), operated by InkSpark ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

InkSpark is an AI-powered tattoo design platform that provides:

  • AI-generated tattoo designs based on user descriptions
  • 3D virtual tattoo try-on simulation
  • Tattoo design inspiration gallery
  • Design customization tools

The Service is intended for personal, non-commercial use unless a commercial license is explicitly purchased.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Providing accurate, current, and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

You must be at least 18 years old to create an account and use the Service.

4. User Content and Conduct

4.1 Ownership

You retain ownership of designs you create using the Service. By using the Service, you grant us a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the Service.

4.2 Prohibited Content

You agree not to use the Service to create, upload, or share content that:

  • Is illegal, harmful, threatening, abusive, harassing, or defamatory
  • Infringes on any intellectual property rights
  • Contains hate speech or promotes discrimination
  • Depicts or promotes violence, self-harm, or illegal activities
  • Contains sexually explicit or obscene material
  • Violates any applicable laws or regulations

5. Intellectual Property

5.1 Our IP

The InkSpark platform, including its code, design, logo, trademarks, and proprietary AI models, is owned by InkSpark and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

5.2 Your Designs

AI-generated designs created through the Service are generally considered your intellectual property, subject to the license terms of your subscription plan. Free-tier designs may include usage restrictions. Paid plans include full commercial rights for designs you create.

5.3 DMCA

We respect intellectual property rights. If you believe your copyrighted work has been infringed through our Service, please contact us at copyright@inkspark.io with a detailed DMCA takedown notice.

6. Payment and Subscriptions

6.1 Pricing

Our pricing is displayed on the pricing page. We reserve the right to change pricing with prior notice. Price changes will not affect active subscription periods.

6.2 Billing

Payments are processed through Stripe. By subscribing, you authorize recurring billing according to your chosen plan. You are responsible for all charges incurred under your account.

6.3 Refunds

We offer a 7-day money-back guarantee for annual plans. Weekly and monthly plans can be canceled at any time to prevent future charges, but payments already made are non-refundable unless required by law.

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. Unused credits expire at the end of the billing period unless otherwise stated.

7. Credits System

Credits are used to generate designs and use premium features. Credits:

  • Are non-transferable and have no cash value
  • Expire according to your plan terms
  • Are consumed per design generation or feature use
  • Cannot be refunded or exchanged

8. Third-Party Services

Our Service integrates with third-party services including Google (authentication), Stripe (payments), and analytics providers. Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or content.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • AI-generated designs will meet your expectations
  • Any errors will be corrected
  • The Service is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INKSPARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless InkSpark, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, illegal activity, or prolonged inactivity. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time through account settings or by contacting support.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
